These Terms and Conditions (“Terms”) apply to your use of patuxentnursery.com (the “Site”), purchases made through the Site, and our text message and email programs. The Site is operated by Patuxent Nursery, LLC (“Patuxent Nursery,” “we,” “us”), 2410 North Crain Hwy, Bowie, MD 20716. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Some of our services have their own terms. Where they apply, those terms control for that service, and these Terms cover everything else:
You must be at least 18 years old to create an account or place an order. You are responsible for keeping your login information confidential and for activity under your account. Please tell us promptly if you believe your account has been used without your permission.
Plants are living products. Size, shape, color, and bloom stage vary from plant to plant and season to season, so product photos are representative and container sizes and heights are approximate. Availability changes quickly, especially in peak season. If an item you ordered is unavailable, we will contact you to offer a substitute or a refund for that item.
Plant care information on the Site, including care guides and blog articles, is general guidance. Results depend on site conditions, weather, and care after purchase.
Prices on the Site are in U.S. dollars and may change without notice. Online prices may differ from in-store prices, and contractor pricing is available only to approved contractor accounts. Applicable sales tax is added at checkout.
We work to keep product information and prices accurate, but errors happen. If a product is listed at an incorrect price or with incorrect information, we may cancel orders for that product, even after you receive an order confirmation. If we cancel an order you already paid for, we will refund the full amount charged.
Your order confirmation email confirms that we received your order. We may decline or cancel an order because of product unavailability, pricing or listing errors, suspected fraud, or delivery addresses outside our service area. If we cancel an order, we will refund any amount charged.
Payments are processed by our third-party payment processor. By placing an order, you confirm that you are authorized to use the payment method you provide.
Online orders are available for in-store pickup or delivery within our service area of Maryland, Virginia, and Washington, D.C. Pickup is governed by our Online Shopping Policy, and delivery is governed by our Delivery Policy & Terms of Service. Responsibility for your purchase passes to you when you pick it up or when it is delivered.
Returns, refunds, and our plant replacement guarantee are described in our Return Policy.
Your rights under Maryland law. Nothing in these Terms or our other policies limits any implied warranty or remedy you have under Maryland law when you buy goods or services from us for personal, family, or household use.
Patuxent Nursery gift cards and store credit do not expire and are not subject to any fees. They can be redeemed in-store or online toward merchandise and services, and cannot be redeemed for cash except where required by law. Please treat gift cards like cash. We cannot replace lost or stolen cards unless you can provide proof of purchase and the card has not been used.
Our Customer Loyalty Program is governed by its own program rules. Rewards have no cash value and cannot be transferred. We may change or end the program as permitted by law. If we end it, we will give reasonable advance notice and an opportunity to redeem earned rewards.
Program description. By opting in to the [Program Name] text program, you agree to receive recurring automated text messages from Patuxent Nursery at the mobile number you provide. Messages may include [promotions, sales and event announcements, seasonal plant arrivals, and order updates].
We do not share your text messaging opt-in data or consent with third parties, except the service providers that deliver our messages. See the SMS section of our Privacy Policy for details.
If you subscribe to our newsletter, you agree to receive marketing emails from us. You can unsubscribe at any time using the link at the bottom of any email. We will still send transactional emails related to your orders and account.
You agree not to:
Our content. Text, photos, videos, care guides, logos, and other content on the Site belong to Patuxent Nursery or our licensors. You may view and print content, including downloadable care guides, for personal, non-commercial use. Any other use requires our written permission.
Your content. If you submit reviews, comments, photos, or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, display, and reproduce it in connection with our business. You confirm you have the right to share it. We may remove content at our discretion.
The Site links to third-party websites and services, such as social media platforms and payment providers. We are not responsible for their content, policies, or practices.
The Site and its content are provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
This disclaimer applies to the Site itself. It does not apply to products or services you buy from us, which are covered by our Return Policy and your rights under Maryland law.
To the fullest extent permitted by law, Patuxent Nursery will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. For any claim arising from a purchase, our total liability will not exceed the amount you paid for the product or service that gave rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including your rights under Maryland consumer protection and warranty law.
You agree to indemnify and hold Patuxent Nursery harmless from claims arising from your misuse of the Site or your violation of these Terms.
If you have a problem with an order or our service, please contact us first at custserv@patuxentnursery.com or (301) 218-4769. Most issues can be resolved quickly this way. If we cannot resolve a dispute informally within 30 days, either party may pursue it in court.
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Any legal action must be brought in the state or federal courts located in Prince George’s County, Maryland, except that either party may bring an individual claim in small claims court where eligible.
We may update these Terms from time to time. Changes take effect when posted, and the effective date above will be updated. The Terms in effect when you place an order apply to that order.
If any part of these Terms is found unenforceable, the remaining parts stay in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies listed above, are the entire agreement between you and Patuxent Nursery regarding the Site.
